Texas

In 2009, state legislatures introduced a proposal to eliminate trans fat in foodservice establishments. Foodservice establishments would have to keep original labels for food or food additives that contain fat for as long as the food or food additive is used, stored, or served by the foodservice establishment. The exception would be trans fat found in deep fried yeast dough or in cake batter. The bill has passed the Senate, and has been placed on the House General State Calendar.

The House has introduced two bills pertaining to nutrition labeling. The first bill would apply to foodservice establishments with 19 or more locations statewide. The nutrition information to be disclosed on menu boards or in brochures is: calories, grams of carbohydrates, grams of saturated fat, and milligrams of sodium. The second bill would apply to foodservice establishments with 20 or more locations statewide. Calorie content is required for all standard menu items, in addition to, the calories derived from fat. The nutrition information that needs to be available at the point of purchase is: calories, total fat, saturated fat, cholesterol, sodium, carbohydrates, complex carbohydrates, sugars, dietary fibers, and total protein. The nutrition information can be displayed in the following formats: on a menu, menu-insert, appendix, supplement, or menu board. The House Public Health Committee is reviewing both bills.

Texas adopted legislation in 2007 that reduced the amount of trans fat used in schools.

In 2003, Texas proposed legislation requiring chain restaurants to provide a nutrition information pamphlet to consumers. The bill died at the end of the legislative session.
